By ordering from Arthouse Central, you agree to these Terms and Conditions and agree to be legally bound to them. Acceptance of the Terms and Conditions creates a legally binding agreement between you and Arthouse Central.
Prices Products and Services
Prices displayed on The Website are in Australian dollars. Prices as subject to change without notice and may not include delivery charges. Arthouse Central reserves the right to correct any errors or misprints in the prices listed on The Websites.
Use & Copyright of Your Images
The Copyright of images generally belong to the person that created the image or the photographer that took the photograph. By providing us with your image either in hardcopy format or as a digital file you acknowledge that you represent yourself as either the owner of the copyright or having express permission from the copyright owner of the image to undertake all actions you engage Arthouse Central to perform.
Arthouse Central claims no ownership rights to any Images supplied by you. By supplying the Image you provide us a perpetual, royalty free, copyright license to copy, display, modify or distribute the image or any derivitives or modifications of the image as we require.
You agree to indemnify Arthouse Central against all costs, fees and legal expenses arising from the claim in the event that any company, person or entity makes a claim against us on the basis that the Image you provided infringes on copyright or intellectual property or any person, company or entity.
Provided we comply with our obligations under these Terms, you warrant that you will not make any claim against Arthouse Central for any use of your images including the copy or publication of your image or for the purposes of advertising our services in any way, and you waive all rights of action or other claims you may have now or in the future against us in respect of any such use.
Pop Art Images
Pop Art Images constitute all images created by Arthouse Central from your Images as set out in the “Pop Art Your Images” section of the website. They include but are not limited to, Warhol, ColourBlock, RetroComic, Arthouse Freestyle and Brixton Pop Art Styles.
All pop art images produced by us are deemed to be the sole property of Arthouse Central. As such, you agree that by using our service you will not copy, modify, alter, transmit or print or allow another party to copy, modify, alter, transmit or print any Arthouse Central Pop Art Image provided by us to you.
A preliminary Web Proof may be provided to you via email to allow you to inspect and approval of the Pop Art Image print version. The Web Proof may contain up to several variations of your Pop Art Image.
You may elect to approve the Pop Art Image or make a single round of “reasonable minor changes” free of charge. Arthouse Central will attempt to affect these changes and present you with a second proof at which point you may accept these changes and approve the proof or nominate further changes to the Pop Art Image. We reserve the right, at our sole discretion, to request additional payment for alterations to your Pop Art Image to affect the second and subsequent rounds of proofs.
Delivery
Arthouse Central uses Australia Post to dispatch smaller Canvas print art works to you. In this case the art works will be sent directly to your nominated business or residential address.
To avoid damage to your art work, we reserve the right to post the artwork to a framing gallery near you. In this case the framing gallery will either stretch your canvas or glaze your artwork for you and you may retrieve your art work at that location. This occurs typically for glazed prints or when the canvas print is larger than 900mm x 900mm we will notify you in this case to arrange an acceptable location before we process your order.
We do not accept responsibility for any delays caused by Australia Post or any courier we may use to send your art works to you.
Delivery prices are for major metropolitan cities within Australia only and do not apply to rural or overseas destinations.
Returns
If your order is Damaged you must immediately contact Arthouse Central and provide all relevant information as requested. We may ask you to return the art work in its original packaging or a portion of the artwork before we process your return. You are responsible for the return of damaged goods to Arthouse Central.
If we determine upon inspection and in our sole discretion, that your artwork was damaged on arrival or in manufacture we may elect to replace the artwork. If we determine that the art work was not damaged upon arrival we will return the product to you at your cost. Otherwise we will elect to replace the product or provide you a refund of the purchase price at our discretion.
Product Quality
You acknowledge that:
(a) The final Pop Art Image is affected by the nature (exposure, camera settings etc.) and quality (resolution, sharpness) of the image and that your Pop Art Image may differ from the examples shown in the applicable section of the website.
(b) The final canvas art work colour provided may differ slightly from the Web Proofs due to differences in your computer monitor calibration.
(c) Unless other wise requested in writing you agree to allow Arthouse Central creative license to improve your images as we deem fit.
(d) It is your sole responsibility to ensure you are satisfied with the look and quality of the Web Proof (where applicable). Written approval for Arthouse Central to proceed from the Web Proof stage to the printing stage constitutes your acceptance of the Web Proof and satisfaction of the art work.
